Advice: Dear Judi

Dear Judy

We are from Fidelity Super Care from Brits and we are members of Saccawu since early last year. But till now nothing happened between Saccawu and us. The guy who is in charge does not care about his members. Every time when we want him in town he says we must come to the office.

When we go there he is not there sometime when we meet him in town he says we must give him our demands. He says he is going to talk to our boss but nothing happens. We think they gave him something. Last year they say they are going to give us increase but they didn’t give us increase of R1.00 but when the month is going they say no increase anymore. Fidelity and Saccawu are playing games with us. Since we join Saccawu early last year.

What they do is to fire and threats as well. This year we didn’t meet this guy but he still receives money from us. This Fidelity SC they want us to work overtime but they don’t pay. Another Fidelity SC at Rosslyn they get good salary and overtime. Soon we will want back money from Saccawu. Concerned member

Dear Concerned member!I then spoke to a Saccawu official by the name of Cde Peter Nche. The Cde acknowledges that workers from this cleaning company were recruited in to Saccawu. According to him, there was an arrangement between him and the members to come to his office. And he is surprised that members instead chose to write to Numsa News and yet they knew where their union office is: [Tom Str, opposite Nories Garage, Brits]. Please contact him at 082 336 8405 to reschedule another meeting.

Dear JudySasingabasebenzi basenkampanini yakwa Durowin. Lenkampani iseZakheni ePiters, eLadysmith. Lenkampani yakha ama-window frame. Ku lenkampani sadilizwa saxoshwa emsebenzini. Into esayidilizelwa ukuthi sasingaphansi kwe union – Numsa. Umqhashi ethu wasidiliza sonke wathi akayifuni i-union. Manje indlela esadilizwa ngayo yabonakala ingetho emthethweni ngokusho kuka organiser [Mbuso Mchunu] wasitshela ukuthi lingenile kwaCCMA, Kodwa asizange siyibone iminyakazo njengokuthethwa kwecala. Asisizwanga lutho.

Thina sadilizwe ngomhlaka 22 June 2001 kuze kube manje asazi ukuthi ngempela kuqhubekani futhi no organiser wethu akaphumeli obala ngaloludaba. Kubuhlungu ngoba asazi ukuthi simephi futhi sizozwa ngobani. Nasi isicelo sethu kuwe Judy: Sicela usitholele lokhu okulandelayo, ingabe lelicala lafakwa kwa CCMA, ingaba likhona yini ohlwini lamacala? Ingaba lokudilizwa okungekho emthethweni kwethu kwafakwa yini kwaCCMA noma e-Labour Court.

Uma kukhona okutholayo sicela usicelele uMbuso asinike i-report back ngaloludaba. Ingoba thina uma siyakuye sicela uthola ulwazi ngathi ukuthi simiphi. Uthi akafuni ukukhuluma nathi, noma bamlandule noma athi ubhizi. Manje okubuhlungu usemane athi uzosibizela amaphoyisa silokhu siza kuye. Manje kwakunguye u-Organiser wethu wakwaNumsa. Okumele konke sikuzwe ngaye okuphathelene nathi. Kodwa-ke manje usishiye ebumnyameni. Sicela u-Organiser asisebenzele ngeqiniso kanye ne Numsa uqobo. Akayeke ukuthi uma sikhalaza athi kithi kufana nokuthatha itshe elincane uliphose olwandle. Sicela ukuthi loludaba uluphathe ngezandla zakho ngokomthetho wakwa Numsa.

Sicela ukuthi nathi kusikhanyele ukuthi simiphi nokuthi uMbuso wasishiyaphi sinethemba elikhulu ngoba sesazise wena sifisa ukuthi lonkeloludaba lufinyelele nakwi Head Officengezandla zakho sicela ukuthi ubambisane nathi kuze kubuye namathemba ngeNumsa. Sisizeke Judy, sinethemba sosheshe siyithole i-report back.

Basebenzi,Emva kokuba ngikhulume no Cde Mbuso Mchunu ngaloludaba, ungibhalele waphendula wathi “It is with great disappointment to receive such a letter from the unknown workers who claims to represent ex-Duran workers. However it is imperative to clear these allegations laid against me. It is indeed true that workers were retrenched and were represented by me up to the end of the whole retrenchment exercise. It was also the same Mbuso who referred the dispute, following the whole legal proceedings as provided by the LRA. It was the very same Mbuso who referred the dispute to the regional legal dept for it to be referred to the Labour Court during the late Skhumbuzo Khanyile’s time.

As this process unfolded, the same workers were given the freedom to visit our local at anytime if they were around town so as to get an update about the status of the case. At times they would come to the office drunk and insult the local administrator. But if around the office, one would appeal to them not to come to the office if they are under the influence of liquor.Currently we are dealing with well behaving comrades who are very clear about the fact that their matter is now being dealt with by national legal dept. We have even arranged a telephonic discussion between them and cde Kwena who is dealing with their matter by using speaker-phones late last year.

This was done by us so as to give assurance that their matter is still on. One therefore wonders who are these unidentified workers who claim not to know anything about this case. I trust this will clear the air” concludes Cde Mbuso. Ngiphinde ngathola ithuba lokuthi ngizwe phela nakucala lomunye wabasenzi ukuze kuvele obala ukuthi kahle-hle ngubani kuloluqheko ufihla iqiniso. Ngikhulume noZakhele Mabaso, owayengomunye wabasebenzi base-Durowin. Uma ebuzwa ukuthi kwakungani uMchunu ebasasazelisa ngamaphoyisa, uphendule wathi “Cha, eyamaphoyisa angiyazi, ngiyaqala nje ukuyizwa!”

Dear JudyI am to attend a disciplinary hearing but I have been informed that only an employee of my company may represent me. As a Numsa Union member do I not have a right to be represented by a union official?

Hi Gaz!”Generally you don’t have a right to be represented by a union official unless you are a shop steward or the disciplinary code of your company provides for representation by a union official” cites Neo Kapa, our National Legal Officer.

Dear JudyThe intention of writing this letter to you is to ask for help and advice from you. I would like you to tell me what I should do if I want to join Numsa. Secondly what should you do if I want my employer to deduct provident or pension fund on my wages. The place where I am working at is a wholesale, in Welkom and the most painful part is that no form I was given to sign or write my beneficiaries after my death, my brother or sister. So please inform me how can I solve these problems of mine. Lastly, am I accepted to join Numsa though I am not working under metalworkers or as an individual without other workers I am working with?
