Employers are `not delaying the process of handing out the surplus in the engineering funds`, says Numsa`s engineering sector coordinator, Thulani Mthiyane.
According to Mthiyane, the reason for the delay is a legal one. Last year, the High Court ruled that pension and provident funds in the engineering industry fall under the Labour Relations Act.
The head of the Financial Services Board (FSB), the institution that monitors all pension/provident schemes across the country, then said that he would challenge this ruling. He wants the schemes to fall under the Pension Funds Act (PFA).
If FSB continues with the appeal, the `process of distribution will be delayed by anything up to four years`, says Mthiyane.
Meanwhile employer and trade union representatives have written a joint letter to the Minister of Finance. They have asked him to intervene in the matter and to try and persuade the FSB not to appeal.
Strengthening employer and trade union representatives` appeal is that the surplus distribution principles that they have agreed on are `98% compliant with the PFA`, says Mthiyane.
The 2% that is not compliant relates to what happens if the funds cannot find ex-members. In terms of the PFA, money that is unclaimed must go to the government or to the FSB. Engineering employer and trade union trustees want the unclaimed monies to go back into the funds.

Werkgewers “vertraag nie die uitbetalingsproses vir die surplus in die ingenieursfondse nie” bedryf nie, síª Numsa se koí¶rdineerder in die ingenieursektor, Thulani Mthiyane.
Die Hoí«r Hof het verlede jaar beslis dat pensioen- en voordeelfondse in die ingenieursbedryf onder die Wet op Arbeidsverhoudinge resorteer.
Maar die hoof van die Raad op Finansií«le Dienste (RFD), wat alle pensioen-/voordeelskemas regoor die land monitor, het toe aangedui dat hy die beslissing sou teenstaan. Hy wil híª dat die skemas onder die Wet op Pensioenfondse resorteer.
“Indien die RFD met die appél voortgaan, kan die verdelingsproses met soveel as vier jaar vertraag word,” síª Mthiyane.
Intussen het verteenwoordigers van sowel die werkgewer as die vakbond “˜n gesamentlike brief aan die Minister van Finansies geskryf. Hulle het hom gevra om in die saak tussenbeide te tree, en om te probeer om die RFD te oorreed om nie te appélleer nie. Verteenwoordigers van die werkgewer en die vakbond síª dat hulle op verdelingsbeginsels besluit het wat 98% voldoen aan die vereistes van die Wet op Pensioenfondse.
Numsa sal oor die volgende paar weke regoor die land vergaderings vir vloerbeamptes hou om die besonderhede van hierdie vertraging te verduidelik.
